BOOKINGS IMPACTED BY WESTERN AUSTRALIA'S CONTROLLED BORDER ARRANGEMENT
Restrictions on entry to Western Australia as part of the controlled border arrangements will be considered an exceptional circumstance.
Requests for cancellation and refund must be made by reply to your booking confirmation email and received within a reasonable time period of the booking date of arrival. Requests received after the departure date will not be considered.
Each case will be considered on its individual merits.
There must be reasonable evidence that border restrictions are the underlying cause preventing travel.
If border entry restriction was in place and known at the time of booking no refund will be provided.
If a booking is made from outside Australia and New Zealand, refunds will not be considered during international border restrictions.
These terms and conditions apply to all bookings made on this website. By booking, you agree to be bound by these terms and conditions. These may change from time to time and you should visit our website regularly to check for updates.
2. Parties to Agreement
2.1 The parties to this agreement are the Conservation and Land Management Executive Body established under section 36 of the Conservation and Land Management Act 1984 (CALM Act) (representing the Department of Biodiversity, Conservation and Attractions) and you.
2.2 You must be 18 years of age or over.
2.3 You are responsible for the acts and omissions of all persons occupying the site included in your booking.
2.4 You must occupy the camp site booked. Bookings are not transferable except at our absolute discretion.
This agreement commences when your booking reference number is provided and we have received camping fees for all campers in full
These terms and conditions or any feature on or accessible through the website may be changed or discontinued at any time and any such changes will be set out on the website.
You agree to pay all fees & charges payable under this agreement. If you do not, you will be liable to pay those fees set out in the Conservation & Land Management Regulations, 2002, as amended from time to time.
5.1 Camping fees
You agree to pay camping fees in full for all campers to confirm your booking
5.2 Park entry fees
Entry fees for vehicles apply in addition to camping fees at some parks. You may pay park entry at the time of booking, on entering the park or by purchasing a park pass
6. Your personal details
6.1 You must provide full and correct personal details at the time of booking.
6.2 You must promptly inform us of any changes to the personal details you provided when you made your booking.
7. At the campground
7.1 You must have proof of booking and proof of identity that you may be required to produce at any time during your stay and we may make take other steps to verify your details at any time. If you cannot verify any of your details at any time we may, at our absolute discretion, declare your booking null and void, release the site to other campers and you will forfeit the full amount of all fees paid.
7.2 You may occupy your booked camp site only during the times indicated in the 'arrival and departure' section of 'more information' for the campground
7.3 If you fail to occupy the site during any night of the booking period without informing us, we may at our absolute discretion, consider that you have cancelled and release the site to other campers.
7.4 If guests additional to those booked arrive, we may, subject to the capacity of the camp site, at our absolute discretion, permit them to stay on immediate payment of the applicable fees.
8. Requests by you to make changes to a confirmed booking
8.1 Changes to dates, guests, and camp sites are not permitted, except at our absolute discretion.
8.2 We will not refund any part of the amount paid in case of your delayed arrival or early departure or if fewer campers than booked occupy the camp site.
9. Cancellation by you
9.1 You must contact us by email to confirm you wish to cancel your booking
9.2 If we receive your email 29 days or more prior to your arrival date we will refund 50% of the total fee paid. Refunds may take up to 30 days to be processed. If we receive your email after this time, no refund will be made.
10. Refunds in exceptional circumstances
We will consider an application made by you to vary the refund we will pay in case of exceptional circumstances beyond your control, at our absolute discretion. Application must be submitted in writing, supported by documentary evidence and received by us within 28 days of your original departure date. If these conditions are satisfied, we will inform you of our decision by email as soon as possible. Our decision is final and we will not enter into any further correspondence.
11. Changes or cancellation by us
11.1 We retain the right to close any part of our parks without notice for management reasons or unforeseen circumstances such as, and not limited to, weather extremes or emergency reasons.
11.2 If we have to change or cancel your confirmed booking we will, where possible, offer you equivalent alternative accommodation for the period of the booking at no additional cost to you. If you decline an offer, or we are unable to offer an alternative, we will refund your fees for all the unused proportion of your booking.
12. Travel insurance
We recommend you consider taking out travel insurance at or before the time you make your booking for recovery of any costs, losses and expenses that we will not refund.
13. Maximum duration of stay and restricted return
13.1 Neither you nor any of the guests included in your booking may make a booking or combination of bookings for more than 28 consecutive nights or, if any of those nights fall outside of Western Australia public school term dates (i.e. those dates fall within Western Australia public school holidays) 14 consecutive nights, in any one park or reserve.
13.2 After a period of maximum stay at any park or reserve, neither you nor any of the guests included in your booking or bookings may make another booking at that park or reserve with an arrival date fewer than 14 days later than your last departure date. If any night of that period of maximum stay is during a Western Australia public school holiday, neither you nor any of the guests included in your booking or bookings may make another booking at that park or reserve for the same Western Australia public school holiday period.
14. Breaches of any of the terms and conditions
14.1 In the event of any breach by you, or other occupants of the booked site, of the terms and conditions of this agreement, or of any applicable legislation or regulation including but not limited to the CALM Act, Conservation and Land Management Regulations, the Biodiversity Conservation Act 2016, the Biodiversity Conservation Regulations, we may at our absolute discretion terminate this agreement and bar you from making further bookings by notice given to you, whether verbally or in writing.
14.2 On termination of this agreement, we shall treat the remainder of the booking period as cancelled.
14.3 If having been notified, whether verbally or in writing, that you are barred from making further bookings, you do make further bookings, we will cancel those bookings and you will forfeit all payment made.
15. Governing Law
This agreement is governed by the laws of the State of Western Australia.
16. Entire Agreement
This agreement constitutes the whole agreement between you and us and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.
None of the terms and conditions in this agreement shall be waived except by written notice signed by the parties to this agreement.
18. Release and Indemnity
Neither the Conservation & Land Management Executive Body ("Body") nor the State of Western Australia ("State") shall be liable, in negligence or howsoever, for any death, injury or illness of or to, or loss of or damage to property, of you or anyone camping with you. You hereby indemnify & shall keep indemnified each of the Body & the State from & against any loss, cost, expense, damage, suit, action, proceeding, claim, demand, liability & cause of action incurred by or alleged or brought against any of those indemnified on account of you, or anyone else camping with you, initiating, bringing or alleging a suit, action, proceeding, claim, demand, liability or cause of action against either or both of the Body & the State in contravention of the previous sentence, or otherwise.
